What California Penal Code 245 Prohibits

California Penal Code 245 addresses assault with a deadly weapon or by means of force likely to produce great bodily injury, which generally means significant or substantial physical harm. Aggravated assault is also commonly used to describe the more serious assault conduct prosecuted under this statute.

A charge doesn’t require proof that the accused made physical contact with another person or caused an injury. Prosecutors must instead address whether the alleged act was willful and would naturally and probably result in the application of force. That distinction separates an assault allegation from a completed battery, which involves the actual use of force or violence against another person.

How an Object May Qualify As a Deadly Weapon

A deadly weapon under Penal Code 245 isn’t limited to a firearm or knife. An otherwise ordinary object may fall within the statute based on how it was allegedly used and whether that use was capable of causing death or great bodily injury.

A bottle, baseball bat, vehicle, or dog may be treated as a deadly weapon depending on the circumstances. California law requires the alleged weapon to be an object separate from the human body, so a person’s hands or feet alone don’t meet this definition. The object’s characteristics, manner of use, and surrounding facts can therefore become central issues in the case.

Penalties for Assault with a Deadly Weapon in Santa Ana

Penal Code 245(a)(1), which covers assault involving a deadly weapon other than a firearm, is a wobbler offense that may be filed as either a misdemeanor or felony. Charging decisions can depend on the weapon allegedly used and the extent of any injury.

Statutory exposure may include:

  • Deadly weapon other than a firearm: A felony filing may carry a state-prison term of two, three, or four years. The statute also permits up to one year in county jail, a fine of up to $10,000, or both a fine and imprisonment.
  • Assault with a firearm: Penal Code 245(a)(2) permits a state-prison term of two, three, or four years, a county-jail term of six months to one year, or a fine of up to $10,000.
  • Weapon-specific or victim-specific allegations: Separate penalty provisions apply to allegations involving peace officers, firefighters, machineguns, assault weapons, or.50 BMG rifles.

A felony assault with a deadly weapon conviction is a strike under California’s Three Strikes law. A felony conviction also imposes a lifetime firearm prohibition. A misdemeanor conviction under the non-firearm deadly weapon provisions generally carries a 10-year firearm prohibition, but a misdemeanor conviction for assault with a firearm can trigger a lifetime firearm ban. These are potential statutory and collateral consequences, not predictions about how a particular case will be charged or resolved.

Defense Issues We Examine in a Penal Code 245 Case

No defense applies automatically. We examine the accusation, witness accounts, physical evidence, and police procedures before identifying the factual and legal issues that may support the defense. Small details can change how the alleged encounter should be understood, so our analysis is both thorough and creative.

Depending on the evidence, our review may address:

  • Self-defense or defense of others: Whether force was used in response to an immediate threat against the accused or another person.
  • Lack of intent: Whether the alleged conduct was willful and satisfied the elements prosecutors must prove.
  • False accusation: Whether the allegation accurately describes what happened and correctly identifies who was involved.
  • No deadly weapon: Whether the object and the way it was allegedly used meet California’s legal standard for a deadly weapon.
  • Inability to carry out the alleged threat: Whether the accused had the present ability to apply force under the circumstances.
  • Procedural violations: Whether law enforcement acted lawfully while investigating, searching, questioning, or arresting the accused.

Moises Aguilar, Esq. takes a personal interest in clients’ cases and directly answers calls. We listen carefully to each client’s account rather than treating the police report as the complete story, then prepare a strategy tailored to the specific allegations.
