Multiple DUI Penalties in California

Santa Ana DUI Defense Attorney

At our firm, Moises Aguilar, Esq., we have taken on some of the toughest DUI defense cases and won. If you are facing charges for DUI and have prior convictions, your future freedom could be lost for a long period of time. State lawmakers have increased the penalties for those who are considered to be "habitual offenders." Read about the various penalties for DUI with prior convictions, and call our firm immediately if you have been arrested. The sooner we get involved in your defense the better the outcome could be. It may be possible to get your charges dismissed, and it is well worth your while to have us review the facts in your case.

Second DUI: Penalties

With one prior conviction on record, you will be subject to higher fines and court fees, up to $2,800. You will lose the legal right to drive for 2 years, and you will be required to complete an 18 month DUI school program as part of your penalty. Once you regain your driver's license, you will be facing greatly increased insurance rates, often about 3 times your former cost. You will spend at least 96 hours in jail or up to 30 days in some cases as a minimum. You will also be forced to pay for the installation of an ignition interlock device in any vehicle you operate.

Third DUI: Penalties

A third DUI carries even harsher penalties. You will be facing fines and fees as high as $2,800, and will lose your license for up to 10 years, with a minimum of 3. You will be forced to attend an alcohol treatment program for 18 months, and there is mandatory jail time for 120 days. There may be alternatives for home arrest, rehab or other alternative in some cases, but in essence, you are facing a long period behind bars, and all the consequences, including loss of your employment.

Fourth DUI: Penalties

A fourth DUI arrest will be filed as a felony. A felony conviction on your criminal record will change your life forever, and not in a good way. You will owe fines and fees up to $2,800, will spend a minimum of 3 years in state prison, permanent revocation of your driver's license.

These penalties are for cases that do not involve an accident, injury or fatality, or cases in which a minor was found in the vehicle at the time of the arrest.
